Scope & acceptance
These terms apply between Solution Roofing Limited (“Solution Roofing™”, “we”, “us”) and the person or entity accepting our quote (“you”, “the customer”).
By accepting our quote in writing, by paying a deposit, or by allowing us on site to start work, you agree to these terms. They form the contract between us.
Our quotes
Quotes are written, itemised, and free. They're valid for 30 days from the date of issue unless we tell you otherwise. After that, prices may change due to material costs.
What's included
Every quote lists exactly what is included — sheet quantities, flashings, penetrations, scaffold, disposal, council fees, and labour. If it's not on the quote, it's not included.
What's excluded
Unless explicitly listed, quotes exclude internal repairs, painting, electrical work, plumbing alterations, asbestos removal beyond standard sheet, structural framing repairs, and consent fees.
Contract formation
A binding contract is formed when you accept our quote in writing (email is fine) and we acknowledge the start date. From that point, both parties are committed to performance under these terms.
Pricing & payment
All prices are in New Zealand dollars and exclude GST unless stated. GST is added at the rate in force at the time of invoice.
Payment schedule (residential re-roofs)
- 10% deposit on acceptance of the quote.
- 40% progress payment when materials are delivered to site.
- 50% balance within 7 days of practical completion and handover.
Commercial & large jobs
Commercial and complex jobs may be staged differently — the schedule will be set out in your quote.
Late payment
Overdue invoices accrue interest at 1.5% per month from the due date. We may also recover reasonable collection costs.
Variations
If we discover something during the job that wasn't reasonably visible at quote stage — rotted sarking, hidden asbestos flashing, structural defects — we'll stop, photograph it, and give you a written variation quote. We won't resume that affected area without your written approval.
If you ask for changes mid-job (additional skylights, profile change, extra penetrations), we'll quote those in writing too. Variations are billed on top of the original contract price.
Materials & ownership
Risk in materials passes to you on delivery to site. Title remains with us until paid for in full. We retain a personal property security interest until invoices are settled.
Workmanship guarantee
We guarantee our workmanship for 5 years from practical completion (extendable to 10 years on request, terms apply). The guarantee covers leaks at flashings we folded or fitted, fixings backing out, and ridge or barge alignment defects.
The workmanship guarantee is in addition to your rights under the Consumer Guarantees Act 1993 and the Building Act 2004.
Manufacturer warranties
The substrate (steel) and paint film are covered by the manufacturer's warranty — typically 15–36 years for ColorSteel™ products. We pass these warranties through to you and submit any claim on your behalf at no charge.
We are not the manufacturer and cannot guarantee outcomes outside our control (e.g. premature paint fade, manufacturer defects). The manufacturer's terms govern those claims.
Site access & safety
You are responsible for providing safe, lawful access to the site during the job. Where access requires neighbour consent (scaffold over a boundary, crane lift), you obtain it — we'll help if you ask.
We are responsible for site safety while our crew is on site, including scaffolding, edge protection, harnesses, and toolbox briefings under the Health and Safety at Work Act 2015.
You agree to keep children, pets, and other trades clear of the work area while we're on site, and to remove or secure any items in the roof space we've told you may be affected.
Asbestos & hazards
If asbestos-containing material (e.g. super-six, asbestos cement flashings) is found during the job, we will stop work, isolate the area, and engage a Class A licensed asbestos removalist. Removal is quoted as a variation unless explicitly included in the original quote.
You warrant that to the best of your knowledge you have disclosed any asbestos, lead paint, or other hazardous materials before work begins.
Liability
To the extent permitted by law, our total liability under any contract is limited to the contract price. We are not liable for indirect or consequential losses (loss of rent, loss of profit, etc.).
Nothing in these terms limits any rights you have under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or any other law that cannot be contracted out of.
We carry $2,000,000 public liability insurance and statutory ACC cover for our crew.
Cancellation
You may cancel the contract at any time before we start on site. If you cancel after we've ordered custom materials (custom-folded flashings, special-order colour), you are liable for the materials cost.
We may cancel if you fail to make a payment when due, fail to provide safe access, or fail to address health-and-safety issues we've raised in writing — in which case we'll invoice for work completed and materials delivered.
Force majeure
Neither party is liable for delay or non-performance caused by events beyond reasonable control: earthquake, severe weather, pandemic, government order, supplier failure, or strike. We'll keep you informed of any delay and resume as soon as conditions allow.
Disputes
If something goes wrong, the fastest path is a phone call — 0800 665 325. Most issues are resolved within 24 hours.
If we can't resolve it together, we'll engage in good-faith mediation through FairWay Resolution before either party starts legal proceedings.
Claims under $30,000 may be brought to the New Zealand Disputes Tribunal. All other disputes are resolved in the New Zealand courts.
Photos & marketing
We may photograph the completed roof from public-access viewpoints (street, drone) for use on our website, social media, and marketing materials. We will not photograph the interior of your home, family members, or vehicles. You may opt out by emailing marketing@solutionroofing.co.nz at any time.
General
These terms, together with the accepted quote, are the entire agreement between us. They override any prior representations.
If any clause is found unenforceable, the rest remains in force.
